We have both successfully challenged and defended the constitutionality of provincial legislation.  Our lawyers have appeared before the Supreme Court of Canada on several occasions, successfully challenging roadside prohibition legislation, setting precedent in relation to Cabinet confidentiality and public interest immunity, and arguing for the constitutionality of the inter-provincial shipping of wine.

We act for the Province of British Columbia, including the Director of Civil Forfeiture for whom we have defended the constitutionality of legislation.  Our civil forfeiture work frequently involves Charter litigation relating to police conduct and evidence subsequently used in forfeiture proceedings.

We are experts in Charter damages, having argued the leading case in British Columbia on the intersection of Charter damages and tort damages.

Our administrative law practice is vital to our clients.  We act in judicial reviews, statutory appeals, and tribunal proceedings involving various public bodies, regulators, boards, professional organizations, non-profit societies, sport governing bodies, and other statutory decision-makers.

Our experience includes frequent success on applications for judicial review, and acting as advisor to a number of tribunals in British Columbia.  We also handle high-profile governance disputes involving organizational authority, recognition, and procedural fairness, including litigation concerning control of a national sport governing body.

We assist clients before decisions are made, during proceedings, and on review or appeal. We bring the record into focus, frame the legal issue clearly, and pursue the remedy that best serves your objective.
